Criminal Defense
If you
have been charged with a crime, you will need

At that time, the entire machinery of the State is
focused geared towards trying the accused. The

Expungements
An
expungement is a process whereby a criminal
conviction or a plea of guilty or no-contest is set
aside and the case dismissed. An expungement
relieves a person of the penalties and disabilities
that result from a criminal
conviction. We can also reduce
certain felony convictions to a misdemeanor and
reduce the effects of a criminal conviction.

Bankruptcy
At the Law
Offices of Henrik Mosesi, our bankruptcy focus is
mainly on Chapter 7 petitions. In Chapter 7
cases, commonly known as liquidation cases, all
dischargeable debts are eliminated and all non-exempt
assets are liquidated. You will get to keep all

On October 17, 2005, all of the
provisions of the Bankruptcy Abuse Prevention Act
of 2005 went into effect. Among
the many changes to the bankruptcy rules are
requirements that a debtor first attend a credit
counseling class and meet a complicated
"Means
Test" before
being able to file a chapter 7 bankruptcy.
Debtors who do not meet the requirements under the
means test can have their case dismissed for
"abuse" at the request of the bankruptcy trustee or
any creditor.
Under a Chapter 13 case, commonly
called a Reorganization for an individual or
a small business, creditors generally receive
some repayment for their debts through a repayment
plan. The repayment plan is usually 36 months
in duration where the debtor pays all of her
disposable income to the court. In return,
the debtor receives full protection under
bankruptcy law which often means stopping a
foreclosure or repossession.
The goal of a personal bankruptcy is
to discharge your existing debts and give you a
fresh start. In other words, once your
discharge is granted, you no longer need to repay
the debts that were incurred before you filed your
bankruptcy.

Personal Injury Matters
Our office
has represented hundreds of individuals in their
personal injury matters and has collected hundreds of

Personal Injury Car Accident:
After an accident stop and identify
yourself. Show your driver's license
and registration to the other party and to any
police officer that may have arrived at the scene
of the accident. This is required under
California Vehicle Code sections 20002 and
20003. Failure to stop and exchange
information at the scene of an accident may expose
you to misdemeanor charges for hit and run and/or
failure to exchange information.
Try to
provide assistance to anyone injured. Make
sure whatever assistance you render to an injured
person is reasonable to you under the
circumstances. California Vehicle code
section 20008 requires one to report any injuries
to the police or make a written report to the local
police or the California Highway Patrol within
twenty-four hours. Also, vehicle code section
16000 requires you to report the accident to the
Department of Motor Vehicles in Sacramento within
ten days if property damage exceeds $750.00 and/or
injury or death has resulted. Use the
official
DMV form to
report your accident.
Get the
other driver's full name, address, insurance
information, date of birth, driver's license number
and license plate number. In order to help

not only contains important information about your
rights, but you can use the pamphlet to jot down
the other person's personal
information.
